1. Acceptance of Terms

By accessing and using PawIQ (the "Service," including our website at https://pawiq.app and mobile application), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to be bound by these Terms, please do not use this Service. These Terms constitute a binding agreement between you and PawIQ ("Company," "we," "us," "our").

3. User Eligibility and Accounts

3.1 Age Requirements: You must be at least 13 years old to use PawIQ. Users under 18 require parental or guardian consent. We require users under 13 to have verifiable parental consent in compliance with applicable laws.

3.2 Account Responsibility: You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities occurring under your account
• Ensuring your information is accurate and current
• Immediately notifying us of any unauthorized access

3.3 Account Termination: We reserve the right to terminate accounts that violate these Terms or engage in illegal activity.

4. Acceptable Use Policy

You agree NOT to use PawIQ for any unlawful purposes or in violation of these Terms. Prohibited activities include:

• Illegal activities in violation of UAE, local, national, or international law
• Harassment, abuse, threats, or discrimination against any person
• Posting false, misleading, or defamatory information
• Violating intellectual property, privacy, or other rights
• Attempting unauthorized access to accounts or systems
• Spreading malware, viruses, or malicious code
• Reverse-engineering or attempting to extract source code
• Automated scraping or data mining without permission
• Using the service for competitive analysis or benchmarking
• Disrupting service availability or functionality

5. Your Content and Pet Data

5.1 Ownership: You retain all rights to your pet data and health information. By using PawIQ, you grant us a worldwide, non-exclusive license to use your data to provide services.

5.2 Data Accuracy: You are responsible for the accuracy of information you provide. Inaccurate health data may result in inaccurate recommendations.

5.3 Sharing with Veterinarians: You control who can access your pet's data. We only share information with veterinarians with your explicit consent.

6. Subscription and Payment Terms

6.1 Plans: PawIQ offers Free, Plus (AED 15/month), and Family (AED 25/month) subscription plans with different features.

6.2 Automatic Renewal: Paid subscriptions renew automatically at the end of each billing cycle. You authorize recurring charges to your payment method.

6.3 Cancellation: You can cancel your subscription anytime through your account settings. Cancellation requests must be submitted before your renewal date.

6.4 Refund Policy:

• Full refunds are available if requested within 14 days of purchase
• After 14 days, refunds are not automatically available
• We may offer partial refunds on a case-by-case basis if requested within 30 days
• Refunds are processed within 5-7 business days

6.5 Price Changes: We reserve the right to modify pricing with 30 days' notice. Existing subscriptions maintain current pricing until renewal.

7. Intellectual Property Rights

All content on PawIQ, including but not limited to text, graphics, logos, images, videos, software, algorithms, and AI models, is the property of PawIQ, our licensors, or content contributors. This content is protected by international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, transmit, modify, or create derivative works without written permission from PawIQ.

8. Limitation of Liability and Disclaimers

8.1 Service "As-Is": PawIQ is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.

8.2 No Warranties: We disclaim all warranties including:

• Implied warranties of merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of content and AI recommendations
• Uninterrupted or error-free service operation
• Absence of harmful code or security vulnerabilities

8.3 Limitation of Damages: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWIQ SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of revenue, profits, data, or business opportunities
• Pet illness, injury, or death (regardless of cause)
• Data breaches or unauthorized access
• Service interruptions or unavailability

Our total liability shall not exceed the fees you paid in the past 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless PawIQ, its founders, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of PawIQ, violation of these Terms, or infringement of any rights.

10. Third-Party Services

PawIQ may integrate with third-party services including payment processors (Tap, Stripe), veterinary directories, and other providers. We are not responsible for third-party services, their terms, or privacy practices. Use of third-party services is at your own risk.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Dubai, United Arab Emirates, without regard to its conflict of law provisions.

Jurisdiction: You irrevocably submit to the exclusive jurisdiction of the courts of Dubai for any disputes arising from these Terms or use of PawIQ. You waive any objections to jurisdiction or venue.

12. Modifications to Terms

PawIQ reserves the right to modify these Terms at any time. Changes become effective when posted to our website. Continued use after changes constitutes acceptance of the updated Terms. Significant changes will be communicated via email or prominent notice.

13. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PawIQ regarding your use of the Service and supersede all prior agreements and understandings.
